This document applies to piZap, piZap.com, and all Digital Palette LLC websites, iOS apps, Android apps, web apps, mini apps, editor tools, AI tools, subscriptions, and related services that link to it.

Privacy Policy
1. Who we are. The services are owned and operated by Digital Palette LLC, 140 W Franklin St. Ste 203 PMB 42, Monterey, CA 93940, USA. In this policy, "piZap", "we", "us", and "our" mean Digital Palette LLC and the piZap services. For privacy questions or requests, contact support@pizap.com or use our support center.
2. Scope. This policy covers information we process when you visit our sites, create or use an account, use the photo editor, collage maker, meme maker, design tools, templates, stickers, fonts, AI tools, mobile apps, web apps, subscriptions, support, social sharing, imports, exports, and related features. App store privacy labels, Google Play Data safety disclosures, in-app notices, and product-specific notices should be read together with this policy.
3. Information we collect. We collect information you provide, information created by your use of the services, and information from service providers or integrations you choose to use.
- Account and profile information: name, username, email address, password or authentication credentials, profile photo, account settings, subscription tier, login provider identifiers, and communications preferences.
- User content: photos, videos, images, projects, edits, templates, fonts, stickers, prompts, generated images, captions, comments, uploads, saved files, exports, gallery posts, and other content you submit or create.
- AI and image-processing information: prompts, source images, generated outputs, tool settings, moderation and abuse signals, feature usage, quota or credit usage, and technical data needed to provide AI or image-processing features.
- Device, usage, and diagnostics: IP address, browser type, device type, operating system, app version, referring page, pages or screens viewed, actions taken, dates and times, crash data, performance data, cookie identifiers, advertising identifiers where permitted, and other logs.
- Payment and subscription information: plan, product, renewal status, invoices, transaction identifiers, billing provider, charge or refund status, and limited billing metadata. We do not store full payment card numbers; payment details are handled by payment providers or app stores.
- Support and communications: messages, request details, attachments, email metadata, survey responses, and records of our responses.
- Social, import, and sharing data: information from Apple, Google, Facebook/Meta, X/Twitter, Dropbox, or other integrations when you connect them or ask us to import, save, login, or share through those services.
- Marketing, advertising, and analytics data: cookie data, pixels, analytics events, ad impressions, conversion data, and related identifiers used to measure, personalize, or improve our services and ads where permitted by law.
Please do not upload or submit sensitive personal information unless it is necessary for your use of the service and you have the right to provide it. User content may contain sensitive information if you choose to include it in an image, prompt, caption, or project.
4. How we use information. We use information to:
- provide, operate, secure, maintain, and improve the services;
- create and manage accounts, saved projects, imports, exports, sharing, subscriptions, purchases, refunds, and customer support;
- process uploads, edits, AI prompts, generated outputs, templates, stickers, and other creative features;
- detect, prevent, and investigate fraud, abuse, security incidents, policy violations, spam, and illegal activity;
- measure performance, debug errors, understand feature usage, test improvements, and develop new products;
- send service messages, account notices, support responses, security alerts, billing notices, and marketing communications where permitted;
- show, measure, and improve advertising and promotions, including interest-based advertising where allowed by your choices and applicable law;
- comply with laws, enforce our terms, resolve disputes, and protect our users, services, business, and legal rights.
5. Legal bases for users in the EEA, UK, and similar jurisdictions. Where required, we rely on the following legal bases: contract performance to provide the services and subscriptions you request; consent for activities such as certain cookies, marketing, or optional permissions where consent is required; legitimate interests in operating, improving, securing, and marketing the services; legal obligations such as tax, accounting, consumer protection, data protection, and law-enforcement obligations; and protection of vital interests in rare emergency situations. You may withdraw consent where processing is based on consent.
6. How we share information. We do not sell your photos, projects, or private saved content for money. We share information only as described below.

To process subscriptions, purchases, renewals, cancellations, refunds, tax, fraud checks, and billing support. Examples include Recurly, PayPal, Braintree, Apple App Store, Google Play, and legacy payment providers. |
AI, image, stock, and creative providers |
To generate images, process edits, remove backgrounds, provide stock content, moderate abuse, and operate creative tools. Examples include OpenAI, Together.ai, Unsplash, Pixabay, and other providers used for the requested feature. |
Analytics, ads, and measurement |
To understand usage, measure conversions, serve or measure ads, and improve products. Examples include Google Tag Manager, Google Analytics, Google advertising products, AdSense/Ad Manager, Meta/Facebook Pixel, and ProfitWell. |
Support, communications, and email |
To respond to support requests, send service emails, manage newsletters, and communicate with users. Examples include Zendesk, Mailchimp, Amazon SES, and similar communications providers. |
Legal, safety, and business transfers |
To comply with law, respond to lawful requests, enforce terms, protect rights and safety, obtain professional advice, manage insurance, or evaluate or complete a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets. |
If you publish content publicly, share a link, post to a gallery, or use a social sharing feature, the people or services you share with may view, copy, use, or reshare that content. We cannot control third-party use after you make content public or share it outside piZap.
7. Cookies, ads, and tracking technologies. See the Cookie Policy below. Some analytics and advertising disclosures may be considered a "sale", "share", or use for targeted advertising under some U.S. state privacy laws even when no money changes hands. See the U.S. State Privacy Notice for your choices.
8. App permissions. Our mobile apps and web apps may request access to device features such as photos, camera, storage, clipboard, or notifications so you can use the requested feature. You can manage permissions in your device or browser settings. If you disable a permission, some features may not work.
9. Data security. We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or storage is completely secure. You are responsible for keeping your login credentials confidential and for using the services from trusted devices and networks.
10. Retention and deletion. We keep personal information only as long as reasonably necessary for the purposes described in this policy, unless a longer period is required or permitted by law.
- Account information and saved user content are generally kept while your account is active or until you delete the account or content.
- Inactive accounts and associated stored images or projects may be deleted after approximately two years of inactivity.
- Billing, tax, fraud-prevention, security, support, and legal records may be kept as needed for legitimate business or legal purposes.
- Backups and cached copies may persist for a limited period before being overwritten or deleted.
- When you ask us to delete an account, we will delete or de-identify account data and associated user content unless we need to retain limited information for legal, security, fraud-prevention, accounting, dispute-resolution, or compliance purposes.
You may delete content or request account deletion through your account settings where available, including My Account, or by contacting support@pizap.com. If you created an account through an app, we will provide an in-app or web link path for account deletion as required by app store rules.
11. International transfers. We are based in the United States, and we and our service providers may process information in the United States and other countries. These countries may have data protection laws different from where you live. Where required for transfers from the EEA, UK, or Switzerland, we rely on appropriate safeguards such as standard contractual clauses, approved transfer mechanisms, adequacy decisions, the EU-U.S. Data Privacy Framework for certified recipients, or other lawful transfer bases.
12. Your privacy rights. Depending on where you live, you may have rights to access, confirm processing, correct, delete, restrict, object, withdraw consent, appeal a denied request, opt out of certain processing, and receive a portable copy of personal information. To exercise rights, contact support@pizap.com. We may need to verify your identity before completing a request. You may also have the right to complain to your local data protection authority.
13. U.S. State Privacy Notice. This section is intended for residents of California and other U.S. states with consumer privacy laws. The exact rights and our obligations depend on whether a law applies to us and to your information.
- Categories collected: identifiers, customer records, protected-classification information if you choose to include it in user content, commercial information, internet or network activity, approximate geolocation, audio/visual and other user content, inferences, sensitive personal information you choose to provide, and other information listed in Section 3.
- Sources: you, your device, your use of the services, connected integrations, payment providers, app stores, support providers, analytics and advertising providers, and other users if they interact with your public content.
- Purposes: the business and commercial purposes in Sections 4 and 6.
- Disclosures: the service-provider and third-party categories in Section 6.
- Sale, sharing, and targeted advertising: we do not sell personal information for money. Our use of advertising, analytics, and measurement technologies may be considered a sale, sharing, or targeted advertising under some laws. You may opt out by adjusting cookie or browser controls, using supported privacy controls where available, or contacting us.
- Sensitive personal information: we do not use sensitive personal information to infer characteristics except as permitted by law and as needed to provide the services, process user content you submit, secure the services, or comply with law.
- Minors: we do not knowingly sell or share personal information of users under 16.
- No discrimination: we will not discriminate against you for exercising privacy rights, but some features may be unavailable if we cannot process information needed to provide them.
- Authorized agents: where allowed by law, you may authorize another person to submit a request for you. We may require proof of authority and identity verification.
14. Children and teens. The services are not directed to children under 13, and users under 13 may not create an account or use the services unless a specific product notice says otherwise and we have implemented legally required parental consent. Users between 13 and 17 may use the services only with permission from a parent or legal guardian. If we learn that we collected personal information from a child under 13 without required consent, we will take reasonable steps to delete it. Parents or guardians may contact support@pizap.com.
15. Third-party services. Third-party websites, app stores, platforms, payment providers, social networks, AI providers, stock-content providers, and integrations are governed by their own terms and privacy policies. We are not responsible for third-party practices.
16. Changes to this policy. We may update this policy from time to time. The updated version will be posted with a new effective date. If changes are material, we may provide additional notice as required by law.
Cookie Policy
1. What cookies are. Cookies, pixels, SDKs, local storage, and similar technologies store or read information on your browser or device. They can be temporary or persistent and may be set by us or by third parties.
2. How we use them. We use these technologies for authentication, security, account state, preferences, app functionality, analytics, performance, advertising, conversion measurement, fraud prevention, and debugging.
3. Third-party cookies and pixels. Third parties such as Google, Meta/Facebook, advertising partners, analytics providers, and embedded integrations may set or read cookies and similar technologies when you use the services.
4. Your choices. You can manage cookies through browser settings, device settings, app permissions, our cookie notices or preference tools where available, and third-party opt-out tools. You can also visit Google Ads Settings and Network Advertising Initiative opt-out. Blocking cookies may affect service functionality. We do not respond to legacy "Do Not Track" signals in a uniform way because there is no single industry standard. Where applicable law requires honoring a recognized opt-out preference signal such as Global Privacy Control, we will treat it as required by that law.
Terms of Use
1. Agreement. These Terms of Use are a binding agreement between you and Digital Palette LLC. By accessing or using the services, creating an account, downloading an app, purchasing a subscription, or clicking to accept these terms, you agree to these terms and to the Privacy Policy above. If you do not agree, do not use the services.
2. Services covered. These terms apply to all piZap and Digital Palette LLC websites, iOS apps, Android apps, web apps, mini apps, editor tools, AI tools, content, templates, subscriptions, downloads, and related services that link to these terms.
3. Eligibility. You must be at least 13 years old to use the services. If you are 13 to 17, you may use the services only with permission from your parent or legal guardian, who is responsible for your use. You may not use the services if you are barred from doing so under applicable law.
4. Accounts. You must provide accurate account information, keep your credentials secure, and promptly update information that changes. You are responsible for activity under your account unless the activity results from our failure to use reasonable security measures. You may not sell, transfer, or share your account except as expressly allowed by us.
5. License to use the services. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the services for personal or internal business purposes, subject to these terms, app store rules, and applicable law. We reserve all rights not expressly granted.
6. Ownership of piZap materials. The services, software, interfaces, designs, templates, stickers, fonts, effects, graphics, code, trademarks, logos, and other piZap materials are owned by Digital Palette LLC or its licensors and are protected by intellectual property laws. piZap is a registered trademark of Digital Palette LLC. You may not copy, sell, sublicense, redistribute, scrape, reverse engineer, or create competing services from piZap materials except as allowed by law or by a written license from us.
7. Your content. You retain ownership of photos, projects, prompts, captions, and other content you submit or create, subject to any rights owned by others. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, edit, display, transmit, and create technical modifications of your content only as needed to operate, provide, secure, support, improve, and enforce the services and as otherwise directed by you. If you publish content publicly or share it, you grant us a license to display and distribute it as part of that public or shared feature. We will not use private saved user content in piZap marketing without your permission.
8. Content responsibility. You are solely responsible for your content and for confirming that you have all rights needed to upload, edit, generate, publish, export, or share it. You represent that your content and your use of it will not violate law, infringe intellectual property, violate privacy or publicity rights, defame anyone, exploit minors, contain illegal sexual content, promote violence or hate, mislead others, or violate these terms.
9. AI features. AI features may use prompts, images, masks, edits, and settings you provide to generate or modify content through us or third-party providers. AI outputs can be inaccurate, similar to third-party content, or unsuitable for your intended use. We do not guarantee that AI outputs are unique, protectable, non-infringing, accurate, or lawful for any purpose. You are responsible for reviewing outputs and for using AI features and outputs legally. You may not use AI features to create or distribute illegal content, sexual content involving minors, deceptive impersonation, unauthorized likeness use, regulated professional advice, malware, spam, election manipulation, harassment, or content that violates others' rights.
10. Acceptable use. You must not misuse the services. Prohibited activity includes: unlawful, fraudulent, harmful, abusive, or deceptive conduct; attempts to gain unauthorized access; interference with service security or availability; automated scraping except for ordinary search indexing that follows robots.txt; bypassing usage limits or subscription controls; uploading malware; probing or testing systems without permission; using the services to train competing models or services without written permission; removing copyright notices; or using piZap assets in a way that suggests endorsement or violates our or a third party's rights.
11. Copyright and DMCA. We respect intellectual property rights. If you believe content on the services infringes your copyright, send a notice to support@pizap.com with the information required by the Digital Millennium Copyright Act: your signature, identification of the copyrighted work, identification of the allegedly infringing material and its location, your contact information, a good-faith statement, and a statement under penalty of perjury that the information is accurate and you are authorized to act. We may remove content and terminate repeat infringers as appropriate.
12. Subscriptions, cancellation, and refunds. Paid plans, including Pro and AI Pro, may renew automatically until canceled. Prices, features, quotas, credits, and plan names may change as allowed by law and the applicable checkout terms. You must cancel before renewal to avoid the next charge. Web subscriptions may be managed through your account page, the billing provider, or by contacting support@pizap.com. App Store and Google Play purchases must usually be canceled and refunded through the applicable app store account tools. If you cancel a paid web subscription within seven days after a charge and request a refund, we will use reasonable efforts to provide a refund unless abuse, chargeback activity, app store rules, or law prevents it. Otherwise, cancellation usually stops future renewal and paid access continues until the end of the paid period.
13. Trials, credits, and usage limits. Trials, promotional credits, AI credits, quotas, and usage limits may be offered or changed at our discretion unless a checkout states otherwise. We may meter usage, prevent abuse, throttle features, or suspend access if usage exceeds limits or harms the services.
14. App store terms. If you download or purchase through Apple App Store, Google Play, Amazon, or another app store, that store's terms also apply. Store terms control store billing, cancellation, refunds, family sharing, device rules, and distribution where they conflict with these terms. For Apple apps, these terms are between you and Digital Palette LLC, not Apple; Apple is not responsible for the app or its content, maintenance, support, warranty, claims, or third-party claims, and Apple and its subsidiaries are third-party beneficiaries of the Apple-related portions of these terms.
15. Service changes and availability. We may modify, suspend, or discontinue any feature, plan, content, or service at any time. We do not guarantee that the services will be uninterrupted, secure, error-free, or available in every location or on every device.
16. Termination. You may stop using the services at any time. We may suspend or terminate access, remove content, or disable accounts if we believe you violated these terms, created risk or legal exposure, infringed rights, abused the services, or used the services unlawfully. We may retain information as described in the Privacy Policy.
17. Disclaimers. The services and all content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.
18. Limitation of liability. To the fullest extent permitted by law, Digital Palette LLC, its owners, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, service interruption, or content loss. To the fullest extent permitted by law, our total liability for any claim will not exceed the greater of the amount you paid to us for the services in the 12 months before the claim or $100. These limits do not exclude liability that cannot be limited by law.
19. Indemnity. To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Digital Palette LLC, its owners, employees, contractors, licensors, and service providers from claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your content, your use of the services, your violation of these terms, your violation of law, or your violation of another person's rights.
20. Disputes, arbitration, and class waiver. Please contact us first so we can try to resolve disputes informally. Except for claims that may be brought in small claims court and claims for injunctive relief involving intellectual property, security, or unauthorized access, you and Digital Palette LLC agree that disputes arising from these terms or the services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Digital Palette LLC waive jury trial and class, collective, consolidated, or representative proceedings. You may opt out of arbitration within 30 days after first accepting these terms by emailing support@pizap.com with your name, account email, and a statement that you opt out of arbitration. If this arbitration section is found unenforceable for a claim, that claim will be brought in the courts described below.
21. Governing law and venue. These terms are governed by California law, without regard to conflict-of-law rules. For claims not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in California, unless applicable consumer law requires a different forum.
22. Export and sanctions. You may not use, export, or re-export the services except as authorized by U.S. law and the laws of the jurisdiction where the services were obtained. You represent that you are not located in a U.S.-embargoed country and are not on a prohibited or restricted party list.
23. Changes to terms. We may update these terms from time to time. The updated terms will be posted with a new effective date. Continued use after the effective date means you accept the updated terms, except where law requires additional notice or consent.
24. Assignment. You may not assign these terms without our written consent. We may assign these terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
25. Severability and entire agreement. If any provision is unenforceable, the remaining provisions remain in effect. These terms and the Privacy Policy are the entire agreement between you and Digital Palette LLC for the services and supersede prior or inconsistent terms, except that app store or product-specific checkout terms may also apply.
